1. Platform Description

TourneyDonk is a marketplace platform that connects poker players ("Donks") with backers ("Stablemasters") for tournament action staking. We facilitate buying and selling shares in tournament poker action, position trading on the secondary market, and settlement of results.

What we are: A technology platform that enables peer-to-peer staking transactions.

What we are not: A gambling operator, bookmaker, or licensed securities exchange. We do not determine tournament outcomes, set odds, or guarantee staking returns.

2. User Eligibility & Account Responsibilities

2.1 Age Requirement

You must be at least 18 years old to use TourneyDonk. By creating an account, you represent and warrant that you meet this age requirement. Accounts discovered to belong to users under 18 will be immediately terminated.

You are responsible for all activity that occurs under your account. If you suspect unauthorized access, contact us immediately at support@tourneydonk.com. We offer two-factor authentication (2FA) for enhanced security on financial transactions.

3. Wallet & Financial Terms

3.1 Wallet System

TourneyDonk operates an internal wallet system for managing funds. Your wallet balance represents credits held in escrow by TourneyDonk, not a bank account or stored value instrument.

4.1 Creating Packages

Donks can create packages representing their tournament action. Each package includes:

A package "fires" when it reaches the fire threshold by the deadline. At that point:

If a package does not reach the fire threshold by the deadline, it is automatically cancelled and all funds are refunded. Donks may also manually cancel packages before they fire.

4.4 Term Immutability

Once a package receives its first backing, the terms are locked. Markup, action percentage, fire threshold, and tournament details cannot be changed. This prevents bait-and-switch fraud.

4.5 Anti-Freeroll Protection

Donks must retain at least 15% equity in their own action. This ensures skin in the game and prevents pure freerolls where the player has no personal risk.

5. Settlement Terms

5.1 Reporting Results

After the tournament concludes, the Donk must report:

Upon result submission, there is a 48-hour verification hold during which Stablemasters can review the receipt and dispute if necessary. Funds are released automatically after this period if no disputes are filed.

If the player cashes, payouts are calculated as follows:

Once verified, wallet credits are applied instantly. You can withdraw to your bank account or reinvest in other packages.

6. Secondary Market Terms

6.1 Trading Positions

After buying into a package, you may list your position for sale on the secondary market. You can sell:

TourneyDonk charges a 5% fee on secondary market trades, deducted from the seller's proceeds.

A $10 verification fee is charged to cover identity verification costs. This fee is non-refundable.

7.4 Data Handling

We do NOT store raw government ID images. Stripe Identity processes verification and returns only a pass/fail result with extracted metadata (name, DOB, ID number). See our Privacy Policy for full details.

7.5 Verification Status

Verified users receive a "Verified" badge on their profile. Verification is valid for 2 years, after which re-verification may be required.

If you believe a settlement is incorrect, you may file a dispute within the 48-hour verification window. Disputes must include:

TourneyDonk admins will review all disputes and make a final determination. We may:

If you disagree with an admin decision, you may appeal by emailing disputes@tourneydonk.com with additional evidence. Appeals are reviewed by a separate team.

9.4 Binding Arbitration

For disputes not resolved through our internal process, both parties agree to binding arbitration under the rules of the American Arbitration Association (AAA). Arbitration will be conducted remotely via video conference.

10. Platform Fees

TourneyDonk charges the following fees:

All fees are disclosed upfront before transactions. We do not charge hidden fees.

11. Limitation of Liability

11.1 Platform as Marketplace

TourneyDonk is a marketplace facilitator, not a party to staking transactions. We do not:

Staking poker players is inherently risky. You may lose your entire stake. Past performance does not guarantee future results. You are responsible for your own staking decisions.

11.3 No Warranties

TourneyDonk is provided "AS IS" without warranties of any kind. We do not guarantee:

To the maximum extent permitted by law, TourneyDonk's total liability to you for any claim shall not exceed the amount of fees you paid to TourneyDonk in the 12 months preceding the claim.

12. Account Termination

We may suspend or terminate your account if you:

You may close your account at any time by emailing support@tourneydonk.com. Outstanding positions must be settled or transferred before closure.

13. Modifications to Terms

TourneyDonk may update these Terms of Service at any time. Changes will be effective immediately upon posting. We will notify you via:

Continued use of TourneyDonk after changes constitutes acceptance of the new terms. If you do not agree, you must stop using the platform and close your account.

14. Governing Law & Jurisdiction

These Terms of Service are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

Any disputes not resolved through arbitration shall be brought in the state or federal courts located in Delaware, and you consent to the exclusive jurisdiction of those courts.
